Card issuers aim at young adults because people tend to be consistent to using their first card, said Christine Lindstrom, U.S. Public Interest Research Group’s higher-education program director. Plus, young adults are highly probable to carry revolving debt and pay late, producing more interest and fees for the card issuers, she said.

Card issuers also will necessitate a co-signers approval to increase credit limits of a cardholder younger than 21. And issuers won’t be permitted to offer T-shirts or trinkets to entice students. Some credit experts say students need a card to start building a credit history and score.

But there’s no need to rush this, and it can boomerang if students mismanage cards. Young adults should worry less about their credit score and focus more on implementing good financial habits between ages 16 and 21, said Craig Watts, a spokesman for FICO, the company that created a universally used credit score. “The credit score will take care of itself,” he says.

A survey made public in April by Sallie Mae reveals that many young adults aren’t knowledgeable managers of credit. Undergraduates on average carried record card debt of $3,173, or 46 percent more than four years earlier.

Various schools, out of concern for students, don’t grant marketers to pitch cards on campus. After a few years of living on their own, paying bills and managing credit, they can apply for a credit card under their own name when they turn 21. Never co-sign, advises Janet Bodnar, author of “Raising Money Smart Kids.” Besides, she added, students are more likely to learn money skills if responsible for their own debt.

Medical Collection Agencies Assist Software Developers Sell Produt

iVolution Medical Systems, a West Hampton, NY-based health care systems firm, is taking a different approach. The four-year-old company, started by former Wall Street consultants to the health care industry, entered the medical receivables space by acquiring experienced billing and collections companies. First there was Professional Health care Billing Services (PHB) of Palm Springs, California in March, and then Continental Collection Services of New York, earlier this month (iVolution Medical Systems Acquires Continental Collection Services, May 13).

Despite the regulatory perplexity surrounding the health care industry, iVolution co-chair and chief financial officer Vince Pipia told insideARM that the medical billing and collection industry is ripe for consolidation. We think (medical billing and collections businesses) are all good cash generators, and they have a coveted relationship with physicians, Pipia said.

Specifically, its that relationship that Pipia wants to capitalize on to provide integrated billing and collections services to health care providers as they transition to health care information systems. Electronic medical records, billing, e-prescriptions and instant messaging are among the solutions offered by the company. Our goal is to build and grow medical billing to cross-sell technology.

In the year since iVolution introduced its products to the market, Pipia said some of iVolutions technology is gaining recognition among its pediatricians. Likewise, iVolutions billing and collections clients are appreciating the benefits of its free instant message technology.

Since conversion to electronic medical records was labeled as the one change that the entire health care industry agrees can boost efficiencies and lower costs, dozens of companies have been working to develop technology solutions. Still, only eight % of health care providers operate fully functioning electronic medical record systems, Pipia said.

Most EMR (electronic medical records) are expensive, Pipia said. Analyst Michael Klozotsky said he expects more ARM industry consolidations and acquisitions as some company owners look to depart from the business to avoid regulatory changes that will come with health reform. However, the health industrys inclination to use more health information technology and the Obama administrations commitment to helping fund the transition leaves an abundance of opportunity for companies that can help health care providers comply with new technology mandates, he said.

$500,000 Awarded to California Couple in FDCPA Case

Last month, Manuel and Luz Fausto won one of the largest collection awards documented in the last couple of years under the Fair Debt Collection Practices Act (FDCPA) against Credigy Services Corporation. A California jury awarded the Faustos $500,000 in damages caused from harassment by Credigy collectors. Of the sum, granted $100,000 was for actual damages the Faustos experienced, while $400,000 was in punitive damages, granted for malicious and reckless disregard of the couples rights. According to one of the Faustos lawyers, David Humphreys of Humphreys Wallace Humphreys, P.C., and the case stemmed from a debt on a Wells Fargo charge card opened in 1992.

Humphreys stated that the Faustos consistently paid the account balance on the credit card, but the balance kept increasing. The Faustos then requested that the account be frozen, but their request was declined by a local Wells Fargo branch. Humphreys said the Faustos received assistance in paying the balance from a local business that promised to negotiate a discounted payoff of credit card balances. The Faustos were under the impression that the debt owed to Wells Fargo was paid off with two money orders in the late 1990s. In 2006, Credigy contacted the Faustos with a demand of almost $17,000. Humphreys noted that a Brazilian affiliate of Credigy made over 90 threatening calls and sent numerous letters to the Fausto home, even after a cease and desist notice was sent to the company.

Luz Fausto recorded the last phone call made by the debt collectors, which documents false claims that threatened the Faustos livelihood. Credigy counter sued the Faustos on the basis that the debt collection call was confidential. Humphreys said that Credigys collection efforts did not end until a lawsuit was filed. Humphreys claimed that the jury award was the largest given to a consumer in a case brought under the FDCPA.

Manny Newburger, an attorney for debt collectors fears that consumer lawyers may make the false assumption that all juries will award large damages because it was awarded in this case. The Fausto case is fact-specific, Newburger stated. In the vast majority of cases there is little or no evidence of actual damages presented by the consumer. This is one reason why other debt collection lawyers are not inclined to let the verdict in this case affect their evaluation of other cases, he noted.

Newburger said that the defendants in this case sued for invasion of privacy, a standard defense but also, a theory that is asserted in a lot of the cases filed around the country involving alleged collection abuse and the jury ruled against the defendant in the invasion of privacy claim. According to Newburger, the verdict was based on state legislation. This is a California specific case, he said.

Newburger argues that the only thing the Fausto case means is that the consumer won. He does not think the size of the award will entice more consumers to sue debt collection agencies. I think this verdict is indicative of what this jury thought of this particular case, but not of anything else, Newburger said. As for the size of the jury award, Newburger said that he had heard of larger rulings in FDCPA cases.

The ruling for the legal penalty is still undecided. Once decided, a judgment could be granted for any sum up to $1,000 for Credigys violations of the FDCPA. It is unknown if Credigy will appeal the ruling. The lawyers for the debt collection agency could not be contacted.
